Continued use of the Services after updates constitutes acceptance of the revised Terms.<\/p><ol start=\"3\"><li><strong> ELIGIBILITY<\/strong><\/li><\/ol><p>You must be\u00a0<strong>18 years or older<\/strong>\u00a0to use the Services. The Services are not intended for minors. Any use by minors is strictly prohibited except under parental consent and a provider\u2019s supervision as permitted by law.<\/p><ol start=\"4\"><li><strong> RELATIONSHIP BETWEEN YOU AND TMBS<\/strong><\/li><li><strong> Independent Providers:<\/strong><br \/>Licensed medical professionals (\u201cProviders\u201d) deliver clinical care through the TMBS platform.<br \/>Each Provider operates independently and is solely responsible for medical decisions and treatment.<br \/>TMBS is a management and technology company that\u00a0<strong>facilitates access to telehealth services<\/strong>but\u00a0<strong>does not practice medicine<\/strong>.<\/li><li><strong> No Patient\u2013Provider Relationship with TMBS:<\/strong><br \/>Your medical relationship exists only with the licensed Provider who reviews your intake, prescribes medication, or provides clinical guidance\u2014not with TMBS itself.<\/li><li><strong> No Pharmacy Relationship:<\/strong><br \/>TMBS is\u00a0<strong>not a pharmacy<\/strong>. Prescriptions are fulfilled by independent, U.S.-licensed\u00a0<strong>503A compounding pharmacies<\/strong>.<br \/>These pharmacies are responsible for dispensing and verifying medications according to state and federal law.<\/li><li><strong> CONSENT TO TELEHEALTH<\/strong><\/li><\/ol><p>By using the Services, you consent to receive medical care via telehealth technology (video, audio, messaging, or asynchronous review).<br \/>You understand that:<\/p><ul><li>Telehealth has both benefits and limitations.<\/li><li>You may decline or discontinue telehealth at any time by contacting your Provider.<\/li><li>Telehealth is not appropriate for all conditions and may require in-person evaluation.<\/li><\/ul><p>Your Telehealth Consent is incorporated into this Agreement and enforceable by TMBS.<\/p><ol start=\"6\"><li><strong> COMMUNICATIONS CONSENT<\/strong><\/li><\/ol><p>You consent to receive secure and unencrypted communications (email, SMS, phone, or portal messages) from TMBS and affiliated Providers for:<\/p><ul><li>Appointment scheduling<\/li><li>Clinical follow-up<\/li><li>Payment or account matters<\/li><li>Educational and promotional communications (you may opt out anytime)<\/li><\/ul><p>While TMBS uses HIPAA-compliant systems, electronic communications carry inherent risks.<br \/>You agree to hold TMBS harmless for any unauthorized access outside of our reasonable control.<\/p><ol start=\"7\"><li><strong> PAYMENT, SUBSCRIPTIONS, AND BILLING<\/strong><\/li><\/ol><ul><li>TMBS and its Providers operate on a\u00a0<strong>cash-pay basis<\/strong>\u00a0only.<\/li><li>TMBS does\u00a0<strong>not bill or accept<\/strong>\u00a0Medicare, Medicaid, or commercial insurance.<\/li><li>You are solely responsible for all costs associated with the Services.<\/li><li>Payment does not guarantee prescription approval; all prescriptions are issued only after Provider evaluation.<\/li><\/ul><p><strong>Recurring Subscriptions:<\/strong><br \/>Your plan may automatically renew monthly. You may cancel at any time before your next billing cycle by emailing\u00a0<strong>billing@trilogymindbodysoul.com<\/strong>.<br \/>Once a medication order has been sent to the pharmacy, the month\u2019s charge is non-refundable.<\/p><ol start=\"8\"><li><strong> PRESCRIPTION PRODUCTS<\/strong><\/li><\/ol><p>Some Services require a valid prescription.<br \/>Providers determine medical eligibility at their sole professional discretion.<br \/>If your prescription is not approved, TMBS will not charge you for that transaction.<\/p><p>TMBS complies with FDA and state laws governing compounding and dispensing.<br \/>Compounded medications are prepared under 503A pharmacy standards and are\u00a0<strong>not FDA-approved<\/strong>\u00a0formulations.<\/p><ol start=\"9\"><li><strong> NO GUARANTEE OF RESULTS<\/strong><\/li><\/ol><p>TMBS and its affiliates make\u00a0<strong>no claims, warranties, or guarantees<\/strong>\u00a0about specific weight-loss results, health outcomes, or treatment effects.<br \/>Individual results vary based on adherence, genetics, and other factors.<\/p><ol start=\"10\"><li><strong> REFUND &amp; RETURN POLICY<\/strong><\/li><\/ol><p>All prescription medications are\u00a0<strong>non-returnable and non-refundable<\/strong>\u00a0under federal law (21 CFR \u00a7205).<br \/>Refunds for supplements or non-prescription products are governed by our separate\u00a0<strong>Refund &amp; Returns Policy<\/strong>, available at\u00a0www.TrilogyMindBodySoul.com\/policies\/refunds.<\/p><ol start=\"11\"><li><strong> THIRD-PARTY LINKS AND SERVICES<\/strong><\/li><\/ol><p>Our website may link to third-party websites or pharmacies.
