- EMERGENCY DISCLAIMER
Trilogy MBS, LLC (“TMBS,” “we,” “us,” or “our”) is not a substitute for emergency medical care.
If you are experiencing a medical emergency, call 911 or go to your nearest emergency department immediately.
- ACCEPTANCE OF TERMS
By clicking “I Agree,” checking a box, or otherwise using our website, mobile app, or telehealth platform (the “Services”), you acknowledge that you have read, understood, and agree to these Terms and Conditions (“Agreement”).
If you do not agree, you must not access or use the Services.
This Agreement creates a legally binding contract between you and Trilogy MBS, LLC, including all subsidiaries, providers, and pharmacy partners.
We reserve the right to update these Terms at any time. Continued use of the Services after updates constitutes acceptance of the revised Terms.
- ELIGIBILITY
You must be 18 years or older to use the Services. The Services are not intended for minors. Any use by minors is strictly prohibited except under parental consent and a provider’s supervision as permitted by law.
- RELATIONSHIP BETWEEN YOU AND TMBS
- Independent Providers:
Licensed medical professionals (“Providers”) deliver clinical care through the TMBS platform.
Each Provider operates independently and is solely responsible for medical decisions and treatment.
TMBS is a management and technology company that facilitates access to telehealth servicesbut does not practice medicine. - No Patient–Provider Relationship with TMBS:
Your medical relationship exists only with the licensed Provider who reviews your intake, prescribes medication, or provides clinical guidance—not with TMBS itself. - No Pharmacy Relationship:
TMBS is not a pharmacy. Prescriptions are fulfilled by independent, U.S.-licensed 503A compounding pharmacies.
These pharmacies are responsible for dispensing and verifying medications according to state and federal law. - CONSENT TO TELEHEALTH
By using the Services, you consent to receive medical care via telehealth technology (video, audio, messaging, or asynchronous review).
You understand that:
- Telehealth has both benefits and limitations.
- You may decline or discontinue telehealth at any time by contacting your Provider.
- Telehealth is not appropriate for all conditions and may require in-person evaluation.
Your Telehealth Consent is incorporated into this Agreement and enforceable by TMBS.
- COMMUNICATIONS CONSENT
You consent to receive secure and unencrypted communications (email, SMS, phone, or portal messages) from TMBS and affiliated Providers for:
- Appointment scheduling
- Clinical follow-up
- Payment or account matters
- Educational and promotional communications (you may opt out anytime)
While TMBS uses HIPAA-compliant systems, electronic communications carry inherent risks.
You agree to hold TMBS harmless for any unauthorized access outside of our reasonable control.
- PAYMENT, SUBSCRIPTIONS, AND BILLING
- TMBS and its Providers operate on a cash-pay basis only.
- TMBS does not bill or accept Medicare, Medicaid, or commercial insurance.
- You are solely responsible for all costs associated with the Services.
- Payment does not guarantee prescription approval; all prescriptions are issued only after Provider evaluation.
Recurring Subscriptions:
Your plan may automatically renew monthly. You may cancel at any time before your next billing cycle by emailing billing@trilogymindbodysoul.com.
Once a medication order has been sent to the pharmacy, the month’s charge is non-refundable.
- PRESCRIPTION PRODUCTS
Some Services require a valid prescription.
Providers determine medical eligibility at their sole professional discretion.
If your prescription is not approved, TMBS will not charge you for that transaction.
TMBS complies with FDA and state laws governing compounding and dispensing.
Compounded medications are prepared under 503A pharmacy standards and are not FDA-approved formulations.
- NO GUARANTEE OF RESULTS
TMBS and its affiliates make no claims, warranties, or guarantees about specific weight-loss results, health outcomes, or treatment effects.
Individual results vary based on adherence, genetics, and other factors.
- REFUND & RETURN POLICY
All prescription medications are non-returnable and non-refundable under federal law (21 CFR §205).
Refunds for supplements or non-prescription products are governed by our separate Refund & Returns Policy, available at www.TrilogyMindBodySoul.com/policies/refunds.
- THIRD-PARTY LINKS AND SERVICES
Our website may link to third-party websites or pharmacies. TMBS is not responsible for their content, security, or practices.
Your use of third-party services is governed by their own terms and policies.
- INTELLECTUAL PROPERTY
All content on the TMBS Platform—including text, graphics, logos, and software—is owned by Trilogy MBS, LLC and protected by U.S. copyright and trademark law.
You may not reproduce, distribute, or modify any content without prior written permission.
- LIMITATION OF LIABILITY
To the maximum extent permitted by law, TMBS, its affiliates, and Providers are not liable for:
- Any indirect, incidental, or consequential damages;
- Unauthorized access to or use of your information; or
- Any outcomes arising from Provider decisions or pharmacy services.
Your sole remedy is to discontinue use of the Services.
- INDEMNIFICATION
You agree to indemnify and hold harmless TMBS, its officers, employees, affiliates, Providers, and pharmacies from all claims, damages, or expenses (including attorney fees) arising from your misuse of the Services or violation of these Terms.
- ARBITRATION AGREEMENT & CLASS-ACTION WAIVER
Any dispute arising from or relating to these Terms will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Healthcare Payor-Provider Rules.
You waive your right to a jury trial and to participate in any class or group action.
Either party may bring a claim in small-claims court if eligible.
This arbitration clause is governed by the Federal Arbitration Act (9 U.S.C. §1 et seq.).
- SEVERABILITY
If any provision of this Agreement is found invalid or unenforceable, the remaining provisions will remain in effect.
- ASSIGNMENT
TMBS may assign or transfer its rights or obligations under this Agreement without notice.
You may not assign this Agreement without our written consent.
- GOVERNING LAW
This Agreement is governed by the laws of the State of Florida, without regard to conflict-of-law rules.
